New York Leads the Way: First U.S. State to Impose Ban on New AI Data Centers
In a groundbreaking move that could potentially redefine the future of AI infrastructure in the United States, New York Governor Kathy Hochul signed Executive Order 62 on July 14, 2026. This order imposes the nation’s first statewide moratorium on new hyperscale data centers. The one-year ban puts a stop to all new state environmental permits for data center facilities that require 50 megawatts or more of electricity — the threshold that defines a hyperscale facility.
The decision is a response to escalating public concern over skyrocketing energy costs. Since 2019, New York’s average residential electricity price has seen a staggering increase of nearly 68 percent. State officials attribute this surge, in part, to the explosive demand from AI-powered data centers. A poll conducted by the Siena Research Institute in June revealed that 46% of New Yorkers are in favor of the moratorium, with only 21% against. This decision has garnered bipartisan support from both Democrats and Republicans.
Throughout the moratorium period, the state’s Department of Environmental Conservation will be tasked with developing a comprehensive Generic Environmental Impact Statement. This statement will assess the effects of data centers on energy demand, water usage, and air quality. In addition, Governor Hochul has announced plans to introduce legislation that would repeal statewide sales tax exemptions for large data center operators. This move would directly increase costs for hyperscale cloud giants including Microsoft, Alphabet, Amazon, and Meta. These companies have collectively indicated over $300 billion in data center capital expenditure plans for the upcoming years.
“Progress shouldn’t arrive with a higher utility bill, depleted water supply or noise pollution,” stated Hochul at the signing ceremony. This bold move sets New York on a potential collision course with the Trump administration, which has cautioned states against regulating the AI industry.
