High-Stakes Trial Between Elon Musk and OpenAI Commences in Oakland Federal Court

Jury selection commenced on Monday, April 27, 2026, marking the beginning of a high-stakes trial between tech billionaires Elon Musk and Sam Altman. The outcome of this trial could potentially shape the future of OpenAI, a company currently valued at a staggering $852 billion.

The civil lawsuit finds its roots in the 2015 inception of ChatGPT creator OpenAI. Initially a nonprofit startup, primarily funded by Musk, the company later evolved into a for-profit venture. Musk alleges that Altman, along with OpenAI president Greg Brockman, deceived him by deviating from the company’s original mission: to serve as an altruistic steward of artificial intelligence technology.

The trial is set to take place over a span of four weeks in the U.S. District Court in Oakland, California. The witness list includes notable figures such as Musk, Altman, Brockman, and Microsoft CEO Satya Nadella. Musk is seeking over $130 billion in damages, payable to OpenAI’s nonprofit arm. Moreover, he is urging the judge to revert OpenAI back to its nonprofit structure and remove Altman and Brockman from their leadership positions.

OpenAI, on the other hand, maintains that Musk was fully aware of and supported the company’s transition to a for-profit entity. They allege that Musk’s departure was triggered when the company refused to grant him full control. The trial unfolds at a critical juncture for OpenAI, with a blockbuster IPO looming on the horizon.
