New Administration May Delay FDA’s Cosmetics Regulations

The U.S. Food and Drug Administration’s (FDA) ambitious plan to update cosmetics regulations is facing significant delays as the incoming Trump administration prepares to take office. Three critical proposed rules required under the Modernization of Cosmetics Regulation Act of 2022 (MoCRA) are now at risk of further postponement.

The FDA was mandated to establish standardized testing methods for detecting asbestos in talc-containing cosmetics by December 29, 2023. However, the proposed rule only emerged on December 27, 2024, nearly a year behind schedule. Additionally, the agency’s proposal for Good Manufacturing Practices (GMPs) for cosmetics, initially due by December 29, 2024, has been delayed until October 2025.

Industry experts warn that the change in administrations on January 20 will likely create more uncertainty for cosmetics manufacturers. These manufacturers have been eagerly awaiting clear regulatory guidance. The MoCRA represents the most significant expansion of FDA’s authority to regulate cosmetics since 1938, affecting everything from lipstick to shampoo safety standards.
