FDA Announces Significant Increase in Color Additive Fees for Cosmetics Industry
The U.S. Food and Drug Administration (FDA) has issued a final rule on November 8, 2024, to increase fees for color additive certification services. The new rule, effective from December 9, 2024, marks the first fee increase since 2005 and is set to significantly impact cosmetics manufacturers who rely on certified color additives.
The revised fee structure includes a $0.10 per pound increase for straight colors, including lakes. The cost for these straight colors will rise from $0.35 to $0.45 per pound. Furthermore, the minimum fee will see an increase from $224 to $288.
Additionally, fees for repacks of certified color additives and color additive mixtures will see an increase. The new fee will be $45, up from the previous $35 for 100 pounds or less.
Industry expert Kelly Dobos emphasizes the significance of this change, stating, “The color certification process for synthetic organic colorants is an important aspect of color additive regulations that is unique to the United States.”
The increase will enable the FDA to continue providing adequate color additive certification programs as required by the Federal Food, Drug, and Cosmetic Act. This will cover rising operational costs, including staff payroll, facility charges, and equipment maintenance.
